How are pre-probate leads different from probate leads?

At All The Leads, we offer both Pre-Probate and Probate leads, but it’s important to understand the key differences and how they work. 


Pre-Probate Leads: 
  • Leads are generated after a notice of death is reported and matched with verified property ownership records. These leads are not tied to the court system and are not guaranteed to go through probate. Instead, they provide a strategic early opportunity to engage with families who may be preparing to sell inherited property — or may never go through probate at all. 
  • Since a probate case hasn’t been filed, there is no official personal representative (PR) on record yet. Our data includes multiple potential relatives identified as likely heirs based on available public records. This allows you to begin outreach and relationship-building early — often before others are even aware of the opportunity. 

 

Probate Leads: 
  • These are pulled after a probate case is officially filed in court. These records include the court-appointed personal representative (PR), the individual legally authorized to make decisions on behalf of the estate. This makes probate leads more definitive in terms of who to contact and confirms that the estate is entering the legal process. 
  • Timing varies: Some families file probate within weeks of a death, while others take months or never file at all. In some cases, a pre-probate lead may later appear as a probate lead once a case is filed, but the two are not directly connected
